These general terms and conditions of use (hereinafter “GTC”) are intended to provide the legal framework for the terms under which the website and services are made available by AFEPAME and to define the conditions of access and use of these services by users (hereinafter “User”). The User must either be an Honorary Member, or a person designated by a Full or Affiliate Member and be connected to the Member, as defined in the statutes, either by a corporate mandate or an employment contract, or be a member of any collegiate management or supervisory body of said Member as defined in AFEPAME’s statutes and annexed to these GTC.
These GTC are accessible on the website https://www.afepame.fr/ (hereinafter the “Site”) under the “GTC” section.
ARTICLE 1: Legal Notices
The publication of the AFEPAME.FR site is provided by AFEPAME whose registered office is located at: AFEPAME C/O AFECEI – 36 rue Taitbout, 75009 Paris (hereinafter “Publisher” or “Afepame”).

The host of the AFEPAME.FR Site is SCALEWAY, a Société par Actions Simplifiée with a share capital of 214,410.50 Euros, headquartered at 8 rue de la Ville l’Évêque, 75008 Paris.
ARTICLE 2: Registration and Access to the Site
Any registration or use of the Site implies the full and unconditional acceptance of these GTC and the AFEPAME Statutes by the User. When registering on the Site via the registration form, each User expressly accepts these GTC by checking the box preceding the following text: “I accept the general conditions of use of the AFEPAME Site and have read the personal data and cookie protection charter.”
If the User does not accept the GTC stipulated herein, the User must refrain from accessing the services offered by the Site.
AFEPAME reserves the right to unilaterally modify the content of these GTC at any time.
The AFEPAME.FR Site provides the User with free access to the following services: Information on the work carried out by the various AFEPAME working groups. Directory of members.
The Site is accessible for free anywhere to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are the user’s responsibility.
A User not belonging to a Member does not have access to the reserved services. To register, they must fill out the form, and this request must be accepted by a representative of AFEPAME’s board of directors. To be a Registered User on this site, the User must be connected to the Member, as defined in the statutes, via a corporate mandate or employment contract, or be a member of a collegiate management or supervisory body of said member. The User undertakes to deregister as soon as their relationship with the Member ceases.
To access the services, the Registered User must then identify himself using the username and password chosen when registering.
Any regularly registered User may also deregister by going to the dedicated page on their personal space. Deregistration will be effective immediately. Otherwise, AFEPAME reserves the right to deregister any User who has left the Member or whose company has lost its member status for any reason.
Any event due to a case of force majeure, resulting in a malfunction of the Site or server, and subject to any interruption or modification in case of maintenance, does not engage the responsibility of AFEPAME. In such cases, the User agrees not to hold the Publisher liable for any interruption or suspension of service, even without notice.

ARTICLE 3: Protection of Personal Data
Personal data processing carried out as part of the use of the Site is conducted with respect for privacy in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and Law No. 78-17 of 6 January 1978 on data processing, files, and freedoms.
By agreeing to sign up for reserved services, the User undertakes to provide a certain amount of personal data listed in the Personal Data and Cookies Protection Charter.

ARTICLE 4: Security
The User undertakes not to interfere with, disrupt, suspend, or slow down the operation of the Site in any way, and to comply with the conditions of access and use. All intrusions or attempted intrusions into information systems, any misuse of the Site’s system resources, any actions likely to overload the infrastructure disproportionately, and, more generally, any breaches of the Site’s security measures are strictly prohibited.
Afepame undertakes to use its best efforts to ensure the security of access to and use of the Site. In particular, Afepame implements all appropriate technical and organizational measures to guarantee the security of the data and content featured on the Site. To this end, Afepame reserves the right, at its sole discretion, to take all necessary measures to counter any abusive use of the Site.
Nevertheless, its liability cannot be engaged for any damages resulting from a third party’s fraudulent intrusion leading to the modification of information published on the Site, its structure, or operation, including in the event of computer viruses.
In the event of a security breach, please inform us as soon as possible at the following address: info@afepame.fr. In this case, Afepame will implement reasonable means to remedy the issue as soon as possible.
ARTICLE 5: Intellectual Property
Use of the Site does not entail any transfer of intellectual property rights, particularly copyright. The Site, its general structure, and each of the elements comprising it (hereinafter collectively referred to as “Elements”) remain the property of Afepame or, where applicable, that of the person who has granted us a license to use them.
Trademarks, logos, signs, as well as all contents of the Site (texts, images, sounds, etc.), are protected by the French Intellectual Property Code and, in particular, by copyright.
The User must seek prior permission from the site for any reproduction, publication, or copying of the different contents. The User undertakes to use the Site’s content strictly within a private, personal, non-transferable framework and for free. Any use for commercial, advertising, or paid purposes is strictly prohibited.
Any exploitation (including reproduction, representation, total or partial translation, modification, for free or for profit), of this Site and its components by any means whatsoever, without the express permission of the Site operator, is prohibited without prior written authorization and would constitute a counterfeiting offense sanctioned by Article L 335-2 and subsequent articles of the French Intellectual Property Code.
It is recalled, in accordance with Article L122-5 of the French Intellectual Property Code, that any User who reproduces, copies, or publishes protected content must cite the author and source.
ARTICLE 6: Liability
The sources of the information published on the AFEPAME.FR Site are deemed reliable, but the Site does not guarantee that it is free from defects, errors, or omissions.
The information provided is given for indicative and general purposes only and has no contractual value. Despite regular updates, the Site cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the Site cannot be held responsible for the use or interpretation of the information contained on this Site.
In general, the information published is strictly reserved for AFEPAME members and must not be communicated outside of the relevant personnel within the member companies.
The Site cannot be held responsible for any consequence and/or damage, direct or indirect, resulting:
- From any failure or improper performance of any or all obligations provided for in the GTC attributable to you, including from the User’s failure to keep their password secret. Any disclosure of the password, in any form, is prohibited. The User assumes the risks related to the use of their username and password.
- From the use of contents, information, and links to third-party sites appearing on the Site;
- From the characteristics and operation of the User’s computer or telephone equipment, browser, telecommunications network, and any other technical means chosen by the User to access the Site;
- From the temporary unavailability or interruption of access to the Site, due to maintenance, updates, or any technical incident beyond our control, or that could not reasonably have been avoided, particularly in the event of interruptions in electricity or telecommunications services;
- From fraudulent third-party intrusions (e.g., viruses) which could infect the user’s computer or any IT equipment as a result of access, use, or downloading content from this Site that led to changes in the information published on the Site, its structure, or operation or any risk of exposure of data and equipment due to Internet use (potential viruses, hacking, etc.);
- From the occurrence of an event qualified as force majeure or the unforeseeable and insurmountable act of a third party as defined by Article 1218 of the French Civil Code and as per French court jurisprudence, and generally any event outside our control preventing the proper performance of our obligations.
ARTICLE 7: Hyperlinks
Hyperlinks may be present on the Site for informational purposes. The User is informed that by clicking on these links, they will leave the Site. The Site has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content. In particular, AFEPAME strives to keep hyperlinks to third-party sites up to date but cannot be held liable if the content of these third-party sites is deleted or changed.
ARTICLE 8: Cookies
The User is informed that during their visits to the site, a cookie may be automatically installed on their browsing software.

ARTICLE 9: Severability
Should one of the provisions of the GTC be deemed null by virtue of a legal principle, any law, regulation, or declared invalid by a judicial decision, the parties agree that the other provisions of the GTC remain in force.
ARTICLE 10: Waiver
Unless otherwise provided, the fact that one of the parties has not required the application of any clause of these GTC shall in no case be considered as a waiver of their rights under that clause.
ARTICLE 11: Applicable law and jurisdiction
French law applies to these GTC. In the absence of an amicable resolution of a dispute arising between the parties, the French courts of Paris will have exclusive jurisdiction.
